<h2 class="wp-block-heading">What&#8217;s Next?</h2>



<p>As you may be aware, last Thursday, March 19th, 2026, the U.S. District Court for the Eastern District of Texas, Tyler Division, issued a ruling in<em> Flowers Title Companies v. Bessent</em> ordering “vacatur and remand” of the <strong>Residential Real Estate Reporting Rule (RRE) </strong>adopted by FinCEN and effective March 1, 2026. The court determined that FinCEN lacked the authority to require reports covered by the RRE.</p>



<h2 class="wp-block-heading">What the Rule required</h2>

<p>Under the RRE Rule, certain professionals involved in closings must file a <strong>Real Estate Report (RER)</strong> for qualifying transactions. This includes <strong>title companies, settlement agents, escrow officers, and closing attorneys.</strong></p>

<h2 class="wp-block-heading">FinCEN acknowledgement:</h2>



<p>FinCEN has acknowledged the federal court decision, and has discontinued any RRE enforcement actions, including the filing of a real estate report. <h2 class="wp-block-heading">What’s next?</h2>



<p>FinCEN has not addressed what might happen going forward with regard to any GTO or other reporting requirements. <strong>It is expected, however, that FinCEN will appeal the court’s decision.</strong></p>



<p>While this guidance provides near-term clarity, uncertainty remains. Future action by FinCEN or the courts could reinstate or modify reporting requirements. </p>

<h2 class="wp-block-heading">ANSI Z765 2021 Standard Explained</h2>



<h3 class="wp-block-heading">What is ANSI Standard Z765-2021 and how does it apply to Real Estate Appraisals?</h3>



<p>As of April 1, 2022, Fannie Mae requires appraisers to follow <strong>ANSI Z765‑2021 (AKA “ANSI standard”)</strong> as the standard for most residential appraisals.</p>



<p>If you have looked at a recent appraisal and noticed that the square footage is different from an older appraisal or listing, there is a reason. In many cases, the difference comes from this national measurement standard, <strong>ANSI Z765‑2021</strong>.</p>



<h2 class="wp-block-heading">What is ANSI Standard?</h2>

<p>ANSI Standard is a nationally recognized standard that explains:</p>



<ul class="wp-block-list">
<li>How a home must be measured</li>



<li>Which areas can be counted as living space</li>



<li>How area calculation of total square footage, also known as <strong>Gross Living Area </strong>or <strong>GLA</strong>, is calculated</li>
</ul>



<p>This standard changed how homes are measured and how living space is reported, bringing consistency to real estate appraisals across the country.</p>



<h3 class="wp-block-heading">The Goal is to Standardize Gross Living Area</h3>



<p>Appraisers must now follow one consistent set of rules. This could affect your home’s reported square footage.</p>



<ul class="wp-block-list">
<li>A new appraisal may not match older appraisals, MLS listings, or tax records</li>



<li>This does not mean the home changed, only that the measuring rules did</li>
</ul>



<p>The goal is fairness, accuracy, and consistency across all appraisals.</p>



<h3 class="wp-block-heading">How Measurements Are Taken Under the Standard</h3>

<p>ANSI Z765‑2021 sets clear rules for how measurements are handled, including:</p>



<ul class="wp-block-list">
<li>Exterior wall dimensions are rounded to the nearest inch or tenth of a foot</li>



<li>Area calculation is rounded to the nearest whole square foot</li>



<li>Measurements follow a uniform, repeatable process nationwide</li>
</ul>



<p>This helps ensure that two appraisers measuring the same home should arrive at very similar results.</p>



<h3 class="wp-block-heading">What Counts as Gross Living Area</h3>

<p>Not all finished space automatically counts as living area under the standard. Several factors now matter, including:</p>



<ul class="wp-block-list">
<li>Ceiling height</li>



<li>Sloped or angled ceilings</li>



<li>Whether any portion of a level is below ground</li>
</ul>



<p><strong>Important points:</strong></p>



<ul class="wp-block-list">
<li>If any part of a floor level is below grade, meaning below ground level, the entire level must be reported as basement area and cannot be included in GLA</li>



<li>This rule often affects bi-level and split-level homes.</li>
</ul>

<h3 class="wp-block-heading">What About 2- to 4-unit Properties?</h3>



<p>Although the standard was written primarily for single family homes, Fannie Mae also requires it to be followed for certain 2- to-4-unit properties, including:</p>



<ul class="wp-block-list">
<li>Detached units</li>



<li>Side by side units that share a single wall, such as townhouses or rowhouses</li>
</ul>



<h3 class="wp-block-heading">How Garages Are Handled</h3>



<p>Garages are not considered living space, even when they are attached to the home. Under ANSI standard:</p>



<ul class="wp-block-list">
<li>Attached and partially attached garages are excluded from GLA</li>



<li>Measurements stop at the interior wall where the garage meets the living area</li>



<li>This is because if there were no garage, that side of the wall would be the end of an exterior wall.</li>
</ul>



<h2 class="wp-block-heading">Benefits of ANSI Z765‑2021</h2>



<p>Although the changes can be confusing at first, this standard provides important benefits:</p>



<ul class="wp-block-list">
<li>More consistent square footage reporting</li>



<li>Fewer discrepancies between appraisals</li>



<li>Clearer explanations of what is and is not living space</li>



<li>Stronger, more defensible appraisal reports</li>
</ul>



<p>While not mandated by HUD nor VA, both allow use of ANSI Z765-2021 measurement standard in their appraisal reports.</p>

<p>Residential appraising has now officially entered a new era. With the institution of UAD 3.6, the traditional way of communicating the appraisal report is undergoing a deep transformation and modernization that affects not only the appraisal community, but also lenders and other stakeholders that have a vested interest in the valuation process. The Uniform Residential Appraisal Report (URAR) as well as many of the other legacy appraisal forms for various property types are being phased out and replaced with a dynamic new reporting structure, an initiative that not only redesigns the reporting format but also transforms the reporting process in its entirety with the goal of standardization.</p>



<h2 class="wp-block-heading" id="lending">FOR THE LENDING COMMUNITY</h2>

<h2 class="wp-block-heading">What the Rule Requires</h2>



<p>Under the RRE Rule, certain professionals involved in closings must file a&nbsp;<strong>Real Estate Report (RER)</strong>&nbsp;for qualifying transactions. This includes&nbsp;<strong>title companies, settlement agents, escrow officers, and closing attorneys.</strong></p>



<h2 class="wp-block-heading">A transaction is reportable if<em>&nbsp;all&nbsp;</em>of the following are true:</h2>



<h3 class="wp-block-heading">The property is residential real estate.</h3>



<p>This includes 1‑4 family homes, condos, co‑ops, townhouses, and vacant land intended for residential construction.</p>



<h3 class="wp-block-heading">The buyer is a legal entity or trust.</h3>



<p>Examples: LLCs, corporations, partnerships, estates, most trusts.</p>



<h3 class="wp-block-heading">The transfer is non‑financed.</h3>

<h2 class="wp-block-heading">What Title Companies Must Report</h2>



<h3 class="wp-block-heading">The Real Estate Report is extensive and must be filed through FinCEN’s BSA E‑Filing system.</h3>



<p>Required details include:</p>



<ul class="wp-block-list">
<li>Property information (address, legal description)</li>



<li>Buyer entity or trust details</li>



<li>Beneficial owners (individuals with ≥25% ownership or substantial control)</li>



<li>Documents for beneficial owners to include name, date of birth, residential address, citizenship, TIN</li>



<li>Seller information</li>



<li>All payment details (type, account sources, etc.)</li>



<li>Identities of signers acting on behalf of entities or trusts.</li>



<li>The reporting person’s full legal name, cascade role, U.S. business address</li>



<li>Date of closing</li>
</ul>



<h2 class="wp-block-heading">Who Can Access Real Estate Reports</h2>



<p>Real Estate Reports will be maintained by FinCEN in&nbsp;<strong>a secure database&nbsp;</strong>along with other Bank Secrecy Act (BSA) reports and, like any other BSA report, will be subject to strict limits on use and re-dissemination.&nbsp;<strong>Real Estate Reports will not be accessible to the general public.</strong></p>



<p><strong>Real Estate Reports are exempt from disclosure under the Freedom of Information Act (FOIA).</strong></p>



<h2 class="wp-block-heading">When The Real Estate Report Is Due</h2>



<p>A Real Estate Report must be filed for any reportable transfer with<strong>&nbsp;a closing date occurring on or after March 1, 2026</strong>. Reporting persons are not required to report transactions that meet the definition of a “reportable transfer” and that close prior to</p>



<p><strong>A Real Estate Report must be filed by the last day of the month following the month in which the date of closing occurred or 30 calendar days after the date of closing, whichever is later.</strong></p>



<h2 class="wp-block-heading">Penalties For Not Reporting</h2>



<p>Negligent violations of the rule could result in a&nbsp;<strong>civil penalty of, as of 2025, not more than $1,430 for each violation</strong>, and an additional civil money penalty of up to $111,308 for a pattern of negligent activity. Willful violations could result in a civil penalty of not more than the greater of the amount involved in the transaction (not to exceed $286,184) or $71,545.</p>



<p>There is&nbsp;<strong>no exception</strong>&nbsp;from reporting under the final rule should a transferee fail to cooperate in providing information about a reportable transfer.&nbsp;<strong>The final rule does not authorize the filing of incomplete reports</strong>, and a reporting person who fails to report the required information about a reportable transfer could be subject to penalties.</p>

<p>It was truly heartwarming to see the results of our office’s food drive. Thanks to our team’s generosity, we gathered a significant amount of food that Teresa and Daniela drove down to the Township of Ocean’s Department of Human Services earlier this week. Our team’s donations will go a long way to help the <a href="https://www.oceantwp.org/p/community-hope-fund">Community Hope Fund of Ocean Township</a> provide Thanksgiving meals to those in need, and we couldn’t be more proud of their kindness.</p>

<p>For the past four years, our office has adopted families in need for the holiday season through <a href="https://www.oceantwp.org/p/community-hope-fund">Community Hope Fund of Ocean Township</a>’s Adopt-a-Family program. Along with gifts on a company level, our staff chips in buying wish-list items for families in need. We had so much fun buying gifts for the families on our list! </p>

<p>As municipal pilot programs prove the efficacy of the blockchain as a tool for land registries and other applications, the title industry is exploring new ways to develop and utilize the evolving technology.</p>



<p>“If blockchain technology has some benefit in the title world to mitigate the risk of seller impersonation fraud, I think that’s something we should be paying attention to,” VP of CATIC Zachary Kammerdeiner said recently.</p>

<p>Builder confidence in the market for newly built single-family homes rose two points to 48 in the Northeast, the Midwest fell one point to 41, the South increased three points to 34 and the West gained two points to 30, according to the National Association of Home Builders (NAHB) Housing Market Index (HMI) released 11/18/25.</p>
